Chapter 7 Trustee William M. McCarthy Required Documents

If you filed for Chapter 7 bankruptcy in the U.S. Bankruptcy Court for the Northern District of New York and your case was assigned to William M. McCarthy, you must send the following documents to him, all of which must be received at least one week before the date scheduled for your meeting of creditors:

  • 2 years of tax returns
  • Title to vehicles
  • If you have any real property in your name (house, cooperative apartment, condominium unit, or vacant land located anywhere in the world) – even if you do not live there, then you must provide a copy of the deed, mortgage, letter from all mortgage companies stating the exact amount needed to pay off the loan(s) in full, appraisal, and the most current bill for real estate taxes on the property
  • Certificate of credit counseling
  • 60 days worth of pay stubs or, if you are unemployed or have had no income in the past 60 days, an affidavit stating that to be the case
  • Statement of monthly net income and any anticipated increase in income or expenses after filing
  • Record of any interest you have in federal or state qualified education or tuition accounts

You should call Mr. McCarthy’s office at (518) 434-6141 no later than one week before the date scheduled for your meeting of creditors to ensure that all documents have been received.  You should also make sure to call Mr. McCarthy’s office prior to sending any documents to be sure that he does not need anything else with respect to your individual case.  Requirements may change from time to time, so spend the few extra minutes to call his office first.

You should never send original documents, and always send your copies by certified or overnight mail so that you can track the package to ensure delivery.

On the day of your meeting of creditors, you must bring the following documents with you:

  • Photo identification (e.g. driver’s license)
  • Original social security card
